The Eagles Want to Trademark “Kelly Green”

The Eagles filed the application with the U.S. Patent and Trademark office on Oct. 31, a little more than a week after the team debuted its long-awaited Kelly green throwback uniforms in a win over the Miami Dolphins.

Specifically, the team is seeking to trademark the use of the term in “education and entertainment services in the nature of professional football games and organizing exhibitions for sporting purposes,” according to the application. Further, the trademark would restrict the use of the phrase “Kelly green” in radio and television programs, football games, live performances and other sporting or cultural events. The application, first reported by trademark attorney Josh Gerben of IP law firm Gerben Perrott, is currently under review.
Okay, so they want to trademark the phrase, but not the color itself. Makes sense. Can’t trademark a color anyway (edit – apparently you can, sort of, which is dumb). That would be craaaaazy, like the guy from the Kia commercials says. Imagine trying to claim ownership of “blue” or “orange.”
