Anthony Gargano, All City, and Beasley Media Reach Settlement
Back in October, Anthony Gargano’s time at 97.5 the Fanatic came to an end when a preliminary injunction was reached in the lawsuit involving Cuz, Beasley Media, and All City (PHLY). Now the case is officially closed as all sides reached a settlement:
This doesn’t change anything in terms of what’s currently going on. Anthony Gargano is no longer with 97.5 the Fanatic and is barred from doing any local content for PHLY until April. He’s allowed to do the national football show with Brian Baldinger and can write national content for All City, but nothing Philly-centric. He can’t disclose confidential information obtained during his employment with Beasley, including ad pricing and rates, Beasley’s client list, ratings information, and things like that. He’s also prevented from soliciting Beasley customers, advertisers, or employees for 18 months.
Essentially, the injunction enforced the non-compete language in his Fanatic contract.
The difference between a preliminary injunction and settlement is that the former halts a specific action before a trial or during a trial, and more or less allows the plaintiff to continue to pursue damages, while the latter closes the case. In layman’s terms, Beasley won’t pursue anything more here, and we are done. Cuz waits two more months, and then he’s able to start doing PHLY content, while 97.5 the Fanatic closes the book.
