Mike Missanelli vs. JAKIB Media: The Never-ending Quest for Sanctions

Welcome to another installment of the Mike Missanelli vs. JAKIB Media civil case. Mikey Miss is suing Joe Krause for what he says is more than $50,000 in unpaid compensation for work performed on the Philadelphia Eagles YouTube show. Krause says Mike never signed his contract and didn’t fulfill all of the requirements, and therefore owes him nothing.
That’s the Cliffsnotes as the discovery phase approaches one full year.
At last check, the most recent victory went to Krause, after Montco judge Jeffrey Saltz denied another motion for sanctions filed by Mike’s attorney. That was in regard to assertions that Krause failed to comply with a court order to produce a certain set of documents. The judge also ruled in early June that both sides should schedule depositions and get those taken care of.
Here we are now, on July 7th, and Krause is filing his own motion for sanctions, alleging that Missanelli is now noncompliant due to:
“…a pattern of bad-faith conduct, including three denied sanctions motions, which have compromised Defendant’s ability to conduct proper discovery from the outset and impacted business operations.
…
Plaintiff’s counsel, Kevin H. Wright, Esq., promised to confirm Plaintiff’s deposition date (July 2,24, or 31, 2025) “quickly” during a June 4 conferral but delayed 19 days until June 23, 2025, necessitating this motion. This delay prevented an earlier reservation of the Montgomery County Bar Association room, now unavailable on July 31 due to a major case, further justifying sanctions.”
Krause is essentially saying here that Mike’s attorney delayed Mike’s deposition, which the attorney accused Krause of doing in April. Basically we have both sides accusing each other of the same exact thing, but two months apart, which is a good snapshot of how goofy this litigation has been.
The motion goes on to allege that the three attempts to sanction Krause amount to harassment and an exploitation of his pro se (self-representation) status. Krause is asking for sanctions against Missanelli, $500 and related reimbursement, plus a hearing on this alleged noncompliance. He also wants an extension of the July 7th discovery deadline “due to Plaintiff’s delays that have hindered Defendant’s ability to conduct proper discovery.“
I asked a couple of lawyers to take a look at this case and share their thoughts. They were more or less unanimous when suggesting the following:
- Krause dragging out proceedings is in his best interest, as he is representing himself and not paying an attorney. They believe there’s little impacting him monetarily, it’s just a matter of the time he’s put into it.
- They believe the judge has been very lenient with Krause’s pro se status.
- They do not think either side has a full grasp of social media.
- It was pointed out that even if Mike wins, he still has to collect the money, which is another possible hurdle. Lawyers also floated the theory that the money is less important at this point than claiming a legal victory.
- They still think this will ultimately result in a settlement of some sort, which both sides said they rejected many months ago.
